1. Acceptance of Terms
By accessing or using the BioCoreClub website ("Site") and purchasing any products ("Products"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site or purchase Products.
2. Research Use Only
All Products sold by BioCoreClub are intended exclusively for in vitro and laboratory research purposes by qualified professionals. Products are NOT intended for human or animal consumption, nor for use in food, drugs, cosmetics, or medical devices. By purchasing, you represent and warrant that you are at least 18 years of age, a qualified researcher or research institution, and that you will use Products solely for lawful research purposes in compliance with all applicable local, state, federal, and international laws and regulations.
3. No Medical Claims
BioCoreClub makes no representations or warranties regarding the safety, efficacy, or suitability of any Product for any purpose other than research. Nothing on this Site constitutes medical advice, diagnosis, or treatment. Products have not been evaluated by the U.S. Food and Drug Administration (FDA) or any other regulatory body. BioCoreClub does not claim that any Product can diagnose, treat, cure, or prevent any disease or condition.
4. Product Information
We strive to provide accurate product descriptions and specifications. However, BioCoreClub does not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free. Product specifications, including purity and composition, may vary between batches. Certificates of Analysis are available upon request.
5. Orders and Subscriptions
By placing an order, you offer to purchase Products subject to these Terms. BioCoreClub reserves the right to accept or reject any order at its sole discretion. Subscription plans renew automatically each month until cancelled. You may cancel your subscription at any time before your next billing cycle by contacting info@biocoreclub.com. Cancellations take effect at the end of the current billing period; no partial refunds are provided for unused portions of a billing cycle.
6. Payment Processing
All payments are processed securely through Square, Inc. ("Square"), a third-party payment processor. By completing a purchase, you agree to Square's terms of service and privacy policy in addition to these Terms. BioCoreClub does not collect, store, or have access to your full credit card number. All prices are listed in U.S. dollars. Subscription plans renew automatically each month until cancelled. You may cancel before your next billing cycle by contacting info@biocoreclub.com. Failed payment attempts may result in suspension of your subscription.
7. Shipping
BioCoreClub ships Products within the United States. Shipping times are estimates and not guaranteed. Risk of loss passes to you upon delivery to the carrier. You are responsible for providing an accurate shipping address. BioCoreClub is not liable for delays caused by carriers, customs, or events beyond our reasonable control.
8. Returns and Refunds
Due to the nature of research chemicals, all sales are final once Products have shipped. If you receive a damaged or incorrect Product, contact us within 7 days of delivery at info@biocoreclub.com with photographic evidence. We will, at our sole discretion, replace the Product or issue a credit.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOCORECLUB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE OR PRODUCTS; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (C) ANY CONTENT OBTAINED FROM THE SITE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL BIOCORECLUB'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO BIOCORECLUB IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless BioCoreClub and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site or Products; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any misuse of Products.
11. Prohibited Uses
You may not use Products for any purpose prohibited by law, including but not limited to: human or animal consumption, athletic performance enhancement without proper authorization, manufacturing of controlled substances, or any use that violates FDA, DEA, or other regulatory requirements. BioCoreClub reserves the right to refuse service to anyone for any reason at any time.
12. Intellectual Property
All content on the Site, including text, graphics, logos, and software, is the property of BioCoreClub and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
14. Changes to Terms
BioCoreClub reserves the right to modify these Terms at any time. We will notify active subscribers of material changes via email. Continued use of the Site or Products after changes constitutes acceptance of the revised Terms.
